Terms of Service

Hummingbird is an online design SaaS that generates brand and launch assets — brand plans, image previews and teaser reels — from the briefs you provide. It is a digital service only. We do not sell, manufacture, ship or deliver any physical goods, and we provide no installation, repair, or on-site service.

You must be at least 13 to use Hummingbird; users aged 13–17 must have verifiable parental or guardian consent. You are responsible for your account credentials and for the activity under your account.

Plans (Nest, Flit, Swift) are billed in USD as a recurring subscription through Stripe. Monthly brand allowances do not roll over. Prices and inclusions are shown on the Pricing page. We may change pricing prospectively with notice; changes never affect a period you have already paid for.

You can cancel anytime; access continues to the end of the paid period. Refunds are governed by our Refund & Cancellation Policy.

You must own or have the right to use any logo, image or text you upload. Subject to these terms and the Content License, you own the assets you generate. However, generated results are creative starting points and are not guaranteed to be unique, original, or free of third-party trademark conflict. You are responsible for completing your own trademark search and rights clearance before any commercial use. Hummingbird is a design tool, not a branding, legal or trademark advisor.

You agree not to use Hummingbird to imitate real brands, create passing-off or counterfeit materials, or produce misleading or deceptive marketing. Full rules are in our Acceptable Use Policy.

AI output may be inaccurate or unsuitable for your purpose. Review everything before you rely on it. See the AI Disclaimer.

The service is provided on an "as is" and "as available" basis without implied warranties. To the fullest extent permitted by law, our aggregate liability is limited to the amount you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law.

We may suspend or terminate access for breach of these terms or the Acceptable Use Policy. You may stop using the service and cancel at any time.

These terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales.
