This explains who owns what: the reference material you upload, and the brand assets Hummingbird generates for you.
1Your uploads
You keep all ownership of the logos, photos and text you upload. You must have the legal right to use them. You grant Hummingbird a limited, non-exclusive licence to process your uploads solely to generate the assets you request. Uploaded reference files are retained only as long as needed and cleared by default within 30 days.
2Generated assets
Subject to your subscription being in good standing and to the Acceptable Use Policy, you own the brand plans, images and reels you generate and may use them commercially.
3No guarantee of exclusivity
Generative tools can produce similar results for different users. We do not guarantee that any generated asset is unique, original, or free of third-party trademark conflict. You are responsible for your own trademark search and rights clearance before commercial use. See the AI Disclaimer.
4Model training
We do not use your uploads or generated results to train AI models. Processing is limited to producing and delivering your requested assets.
5Our brand
The Hummingbird name, site design and marketing content remain the property of DIGITAL HUMMINGBIRD LIMITED. This licence does not grant you rights to use our brand.
